TERMS AND CONDITIONS
The terms and conditions under which you (the ‘Customer’) purchase products from Propellis Pty Ltd (‘Propellis’) are set out below. By placing an order, you acknowledge that you have read, understood and consent to be bound by the terms and conditions of supply.
Minimum Order Quantities: Propellis has a wholesale licence to supply a minimum of 4 litres which is equivalent to 6 x 750ml bottles of wine. Orders that come in under this 4 litres quantity are illegal under our Liquor Licence conditions.
Delivery: Propellis will deliver stock to the Customer within a 48-hour period in the metropolitan area; if you are situated outside the metropolitan area, the delivery time will be discussed and agreed at the time of placing the order. Contact may also be made with Propellis to arrange same day delivery (orders placed before 10:00am) and next day delivery (orders placed before 1:00pm).
Pricing: All prices are quoted in Australian dollars, and may be per bottle or per case, as stated. Propellis reserve the right to alter pricing of a product(s) at any time at the sole discretion of the company.
Payment Options: Propellis accept EFT payments as detailed on the Customer’s tax invoice.
Terms of Sale: Payment is to be made within 14 days of the date of the invoice. Risk in the goods shall pass to the Customer on delivery and legal ownership of the goods will only be transferred to the Customer when receipt of payment is received. Payment must be made in full without any deduction or withholding except as required by law.
Taxes: Goods and Services will be subject to GST at a rate of 10% and wine will be subject to Wine Equalisation Tax (WET) at the rate of 29% unless an exemption is applicable. Any WET exemption claims will require a valid tax exemption number form to be provided to Propellis by the Customer.
Overdue Accounts: Propellis may, in its absolute discretion, suspend the provision of goods and services (including credit) if payment has not been made in full as per these terms. Any costs in recovering outstanding monies shall be paid by the Customer.
Returns and Refunds: If you are not satisfied with the order you have received from Propellis, contact us by email at contact@propellis.com.au within one week of receipt of goods with relevant details: name, invoice number, goods description and reason for return. Where product is to be returned within the metropolitan area, Propellis will arrange to collect the product from the Customer at a mutually convenient time. Contact Propellis directly to arrange a return if you are situated outside of the metropolitan area.
The Customer must keep wine in a safe and proper manner and take reasonable care of it; wine should be returned in its original packaging or packed to avoid breakage during transport back to Propellis.
A refund will be made if the product:
· does not meet the product description, were sent in error or broken/damaged during delivery
· is found faulty or defective upon internal testing of the wine
If a refund of product is deemed reasonably appropriate by Propellis, the purchase price will be refunded within 30 days of return.
Change of Ownership or Details of Customer: The Customer must notify Propellis Pty Ltd in writing of any change in ownership of the Customer, or of shares or of directors of the Customer if a company, or of any change of business address or registered office of the Customer, within 7 days of the change.
General
The terms and conditions under which the Customer (‘you’) purchase products from Propellis Pty Ltd (‘Propellis’) are set out below. By placing an order, you acknowledge that you have read, understood and consent to be bound by the Terms and Conditions (‘T&Cs) of supply.
By subscribing to the Propellis Wine Family and/or placing an order, you agree that you are subject to and must comply with these T&Cs. If you do not agree, please contact us immediately via contact@propellis.com.au to cancel your subscription and order. By continuing your subscription and/or order, you accept the T&Cs as detailed below.
Subscription
To subscribe, you must be 18 years of age or over and complete the Propellis Wine Family subscription process before placing an order.
You must provide correct information in your registration. If your information changes after your registration, before placing any further orders you must contact us to update your details at contact@propellis.com.au .
You are solely responsible for the use of your subscription, including for any other person who uses your details to order products. You agree to notify us immediately if you become aware that your details may have been compromised or if you believe any unauthorised person has accessed your account.
Placing an order
In accordance with the Liquor Control Act 1988, you must be 18 years of age or over to place an order. You may order products by submitting your order via contact@propellis.com.auin accordance with these T&Cs.
Any order placed for a product constitutes an offer by you to purchase the product to be supplied by Propellis, for the price displayed, at the time the order is placed, and in agreement that you will also pay any delivery fees, pick and pack fees (if applicable) as indicated.
Your order may be accepted or rejected, including if Propellis are unable fulfil the order for any reason; if the requested products are not available, if there is an error in the price/product description or if there is an error in your order. If Propellis rejects your order, you will be notified of that rejection within a reasonable time after the order is placed.
If requested, you must be able to provide evidence that you are over 18 years of age and must ensure that a person over the age of 18 is available to accept delivery. Orders will not be left unattended under any circumstances and we reserve the right to cancel your order in whole or in part if we believe any of the above conditions may not be met.
Minimum and Maximum Order Quantities
In accordance with Propellis’ wholesale licence, you are required to place an order of minimum 4 litres, which is equivalent to 6 x 750ml bottles of wine. Orders that come in under this 4 litres quantity are illegal under our Liquor Licence conditions.
We may limit the number of any one product you can order.
You must not order with the intent to resell items including for trade purposes or place multiple orders for the purpose of circumventing the maximum purchase limits under these Terms. If we believe you are placing an order, or multiple orders, under one or multiple accounts, for such purposes, your order(s) may be cancelled without notice.
Modifying your order
Orders requiring modification may be accepted at Propellis’ discretion, providing notice is given within 24 hours of placing your order via contact@propellis.com.au
GST
All fees and charges identified in these T&Cs include GST where applicable. A tax invoice will be issued to you when your purchase is complete.
Payment
Propellis accept EFT payments as detailed on the Customer’s tax invoice.
Delivery
Propellis will arrange delivery solely once payment has been received. Your order will be delivered to you within 7 days in the Perth metropolitan area; if you are situated outside the metropolitan area, the delivery time will be discussed and agreed at the time of placing the order. Contact may also be made with Propellis to arrange priority/urgent delivery (orders placed before 10:00am).
You, or a person representing you, must be present to accept the delivery of your order during the time selected for delivery. The Delivering Party will not leave a delivery unattended for any reason. The person accepting the order must be able to provide proof of identity, and where relevant this must include proof of age.
You agree that Propellis shall not be responsible for any loss or damage to the products in your order after the delivery has been made. If the Delivering Party reasonably believes that the delivery address provided is not safe for any reason or that your order is likely to be stolen or damaged, the Delivering Party may refuse to deliver your order.
If there is no-one available (including where required a person over the age of 18) at the delivery address to accept your order during the time period you selected, or if the Delivering Party cannot access the delivery address, your order will not be delivered. If delivery cannot be made in these circumstances, we reserve the right to charge a cancellation fee of up to $50 for your order.
Order cancellation
If you wish to cancel your order after processing, please contact Propellis via contact@propellis.com.au. Under these circumstances, we may charge you a cancellation fee of up to $50.
